- Introduction Welcome to InvestaLink, a platform that connects property deal sourcers (“Sourcers”) with potential investors (“Investors”). These Terms and Conditions (“Terms”) govern your access to and use of the InvestaLink website, app, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
- User Accounts and Registration To use the Service, you must register for an account. You agree to provide accurate, complete, and current information during registration and to update such information to keep it accurate, complete, and current. You are responsible for safeguarding your password and for any activities or actions under your account. You agree not to disclose your password to any third party.
- User Responsibilities and Conduct
- Sourcers agree to provide accurate and truthful information about all property deals listed on the platform. All listings must comply with relevant property laws and regulations.
- Investors agree to conduct their own due diligence on any deal presented on the platform. InvestaLink is not responsible for the accuracy of deal information or the outcome of any investment.
- All Users agree not to use the Service for any unlawful purpose or in any way that could harm, disable, or impair the Service. This includes, but is not limited to, sharing false information, engaging in fraudulent activities, or harassing other users.
- Our Role as a Platform InvestaLink is a platform that facilitates connections between Sourcers and Investors. We do not act as a broker, agent, or principal in any transactions. We are not a party to any agreements or contracts between users. We do not endorse any specific deals, Sourcers, or Investors. All agreements and transactions are solely between the users.
Fees and Payments
- Investor Fees InvestaLink is free for Investors to subscribe to and use. Investors will only incur a fee if they agree to a deal presented on the platform. The fee is a sourcing fee paid directly to the Deal Sourcer as part of the transaction for the property deal. Investor Link is not responsible for the collection or transfer of this fee. The amount of the sourcing fee will be agreed upon by the Investor and the Deal Sourcer and will be outlined in the deal terms.
- Deal Sourcer Subscription To list deals on the platform, after the Free Trial Period, Deal Sourcers must subscribe to a paid plan. There are three subscription tiers: Basic Plan, Pro Plan, and Elite Plan. Each plan is a 30-day rolling contract, which means you will be billed every 30 days.
- Your subscription will automatically renew at the end of each 30-day period.
- You can cancel your subscription at any time by navigating to your account settings and following the cancellation procedure.
- If you cancel, you will have access to your plan benefits until the end of the current 30-day billing cycle. No further charges will be made after the cancellation takes effect.
- We do not offer refunds for any partial subscription periods.
- Payment Authorization By subscribing to a plan, you authorize us to charge your designated payment method on a recurring 30-day basis for the duration of your subscription until you cancel. You are responsible for ensuring your payment information is accurate and up-to-date. If a payment fails, we may suspend or terminate your access to the Service.
- Disclaimer of Warranties The Service is provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability To the fullest extent permitted by law, InvestaLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.
- Intellectual Property All content, trademarks, and data on the Service, including but not limited to text, graphics, logos, and software, are the property of InvestaLink or its licensors and are protected by intellectual property laws. You may not use any of this content without our express written permission.
- Termination We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.
- Changes to the Terms We reserve the right to modify these Terms at any time. We will notify users of any changes by posting the new Terms on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
